Welcome to Usfira Furniture! These Terms & Conditions ("Terms") govern your use of our website and the purchase of luxury furniture through our online store. By accessing or using our website, or by placing an order, you agree to be bound by these Terms.

2. Your Contract with Us

2.1.

Eligibility:

To place an order, you must be at least 18 years old and capable of entering into a legally binding contract.

Order Placement:

All orders placed through our website are an offer to purchase the furniture and are subject to acceptance by us.

2.3.

Order Acceptance:

Your order is accepted, and a contract is formed, when we send you an email confirming dispatch of your order, or in the case of made-to-order items, an email confirming your order has been placed with our supplier for manufacturing. We reserve the right to decline any order for any reason.

2.4.

Product Representation:

Product images on our website are for illustrative purposes only. While we strive for accuracy, actual products may vary slightly in colour, texture, and other details due to natural variations in materials (e.g., wood grain), monitor settings, and the handcrafted nature of our furniture. All sizes, weights, dimensions, and measurements are approximate and are provided for guidance only, with a usual tolerance of +/- 2%.

3. Pricing and Payment

3.1.

Prices:

Delivery Charges:

4. Manufacturing and Delivery

4.1.

Made-to-Order:

Many of our luxury furniture pieces are hand-crafted and made to order by our trusted suppliers. This means delivery times can vary. Estimated lead times will be provided on the product page and/or at checkout. These are estimates only and are subject to change.

4.2.

Supplier Direct Delivery:

Your furniture will be delivered directly from our supplier(s) to your specified delivery address.

4.3.

Delivery Access:

It is your responsibility to ensure that the delivery address is accessible for large furniture items. You must inform us of any potential delivery restrictions (e.g., narrow doorways, stairs, limited access roads) at the time of order. Failure to do so may result in additional charges or inability to deliver.

4.4.

Delivery Delays:

We are not responsible for delays outside our reasonable control (e.g., supplier production delays, customs issues, courier delays, force majeure events). We will inform you as soon as reasonably possible of any significant delays.

4.5.

Missed Delivery:

If you are not available to accept delivery on the pre-arranged date, a re-delivery charge may apply.

4.6.

Inspection on Delivery:

You must inspect the furniture immediately upon delivery and note any damage or defects on the delivery note. Any significant damage must be reported to us within [e.g., 24-48] hours of delivery.

5. Your Rights to Cancel and Returns

5.1.

Your Right to Cancel (Cooling-off Period):

* For most online purchases, you have a legal right to cancel your contract within 14 days without giving any reason. This "cooling-off period" starts the day after you receive your furniture.
* To exercise this right, you must clearly inform us of your decision to cancel by email or post.
* You then have a further 14 days to return the furniture to us (or our nominated supplier/warehouse).

Exclusions:

This right to cancel does not apply to furniture that is custom-made or personalised to your specifications, as these items are exempt under consumer protection laws. This will be clearly stated on the product page where applicable.

5.2.

Condition of Returned Items:

If you cancel an order under the cooling-off period, the furniture must be returned in its original condition, unused, and in its original packaging. A deduction may be made from your refund if the value of the goods has been reduced as a

result of unnecessary handling by you (beyond what is necessary to establish the nature, characteristics, and functioning of the furniture).

5.3.

Cost of Returns:

You are responsible for the direct cost of returning the furniture when exercising your right to cancel, unless the item is faulty or not as described.

5.4.

Refunds:

We will process your refund within 14 days of either receiving the returned furniture or receiving proof of return, whichever is earlier. The refund will include the basic delivery cost (if applicable), but not any enhanced delivery services you may have chosen.

5.5.

Faulty or Misdescribed Items:

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 if the furniture is faulty, not as described, or not fit for purpose. In such cases, please contact us immediately, and we will arrange for inspection, repair, replacement, or refund as appropriate.

6. Intellectual Property

6.1. All content on this website, including text, graphics, logos, images, and product designs, is the intellectual property of Usfira Furniture or our suppliers and is protected by copyright, trademark, and other intellectual property laws.

6.2. You may not reproduce, distribute, or otherwise use any content from our website without our express written permission.

7. Limitation of Liability

7.1.

We are responsible for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

7.2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products; and for defective products under the Consumer Protection Act 1987.

7.3. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will only use your personal information as set out in our Privacy Policy, which is available on our website. By using our website and placing orders, you agree to our collection and use of your data as described in the Privacy Policy.

9. General Provisions

9.1.

Severability:

If any part of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Waiver:

Any failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising from or related to these Terms, unless you are a consumer living in Scotland or Northern Ireland, in which case you can bring proceedings in your local courts.
